Sub: Implementation of pay fixation orders in terms of the Hon’ble CAT, Principal Bench, New Delhi’s order dated 6th March, 2017.
Reference is invited to Department of Expenditure Office Memorandum No. F No.8-11/2017-E.III(A) dated 7th February, 2018 issued in compliance of CAT New Delhi’s Judgement dated 6.03.2017.
It has been decided that consequent to implementation of 6th CPC w.e.f. 1.1.2006, Assistant Accounts officers of Central Civil Accounts Service shall be allowed minimum entry pay as applicable for direct recruits in the G.P. of Rs.4800/- i.e. Rs.18150/- (B.P.13350 + G.P. Rs.4800) from the date of their appointment on promotion. The re-fixation of pay would be of course admissible from the date of promotion in each of the individual cases. Further, they shall also be entitled to arrears arising out of pay fixation. But, no interest on payment of arrears will be admissible.
However, AAOs on such fixation will not be treated as direct recruits to the post of Assistant Accounts Officer.
These issues with the approval of the competent authority.

On the same analogy, Assistants prmoted during 6th cpc and denied minimum entry pay of Rs.12540+4600, should also be given the benefit. It is regretted to infom tbat Assistants who have been promoted in 2009 and 2015 are drawing same basic pay as on 01..01.2016.. Request to set right the embarassment facing by the seniors.

It will be settled in next MACP of completion of 10 years from your old MACP by the next matrix level of pay in 7th CPC.

Organized accounts service are civil accounts, defence and postal accounts. Since it is applicable for civil accounts, other organised acctts may act upon as per my view. Pl clarify.

Whether this order will apply to ACP II Promotees are also whose ACP II promotion in the pay band of 9300-30000 +GP 4800 has been treated as regular promotion for all purposes as per clarification 20 under GPI ,Ministry of Personnel and Training OM No 28027/9/99/Esst(A) dated Ist May 2000 as per which
“On ACP Promotion ,the financial benefits under the ACPS shall be final and no pay fixation benefits shall occur at the time of regular promotion’
in other words
“Upgradation under ACPS shall be treated on par with regular promotion in so far as pay fixation is concerned
