Sub: Minimum rates of wages and variable dearness allowance w.e.f. 01.10.2017.

A copy each of Orders No.(i) 1/13(7)/2017-LS.II, (ii) 1/13/(6)/2017-LS.II, (iii) 1/13/(5)2017-LS.II, (iv) 1/13/(4)/2017-LS.II (v) 1/13/(3)2017-LS.II and (vi) 1/13(1)/2017-LS-II dated 06.10.2017 revising the rates of variable dearness allowance for contract workers engaged in (i) Loading and unloading in goods sheds, parcel offices of Railways, and other goods – sheds, godowns, warehouses and other similar employments (ii) Watch and Ward (Without arms) (iii) Employment of sweeping and cleaning excluding activities prohibited under the Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act, 1993 (iv) Stone mines (v) Construction or Maintenance of Roads or runways or in Building Operations including Laying Down Underground electric, wireless, Radio, Television, Telephone, Telegraph and Overseas Communication Cables and Similar other Underground cabling work, Electric lines, Water supply lines and Sewerage Pipe Lines and (vi) Agriculture respectively is sent herewith for information and strict compliance. The rates are applicable w.e.f. 01.10.2017.

2. Railways, being Principal Employer are required to ensure that the contractors are complying with the provisions of the Contract Labour (R&A) Act, 1970 and Minimum wages Act, 1948 strictly and arranging prescribed minimum wages to the contract labourers.

3. This issues with the concurrence of the Finance Directorate of Ministry of Railways.

In Exercise of the powers conferred by Central Government vide notification No. S.O. 192(E), dated 19th January, 2017, of the Ministry of Labour & Employment the undersigned, hereby declares that there shall be no increase in Variable Dearness Allowance for the period of 1.10.2017-31.3.2018 due to decrease in the average Consumer Price Index for the period January, 2017 to June, 2017 for the workers employed in Industrial Workers. and thereby resulting in the VDA remaining the same as it was during the period of 1.4.2017 to 30.9.2017. This order shall come into force w.e.f. 01.10.2017.

RATES OF V.D.A. FOR EMPLOYEES EMPLOYED IN LOADING A. ND UNLOADING IN (i) GOODS SHEDS, PARCEL OFFICES OF RAILWAYS, (Li) OTHER GOODS-SHEDS, GODOWNS, WAREHOUSES AND OTHER SIMILAR. EMPLOYMENTS; (Hi) DOCKS AND PORTS; ADD (iv) PASSENGERS GOODS AND CARGO, CARRIED OUT AT AIRPORTS (BOTH INTERNATIONAL AND DOMESTIC).

Therefore, the minimum rates of wages including the basic rates and Variable Dearness Allowance payable w.e.f. 01.10.2017 to the employees would be same under :

The VDA has been rounded off to the next higher rupee as per the decision of the Minimum Wages Advisory Board.

The classification of workers under different categories will be same as in Part-I of the notification, whereas classification of cities will be same as in the Part-II of the notification dated 19th January, 2017. The present classification of cities into areas A, B & C is enclosed at Annexure I for ready reference.

The rates of Variable Dearness Allowance far workers employed in CONSTRUCTION OR MAINTENANCE  OF ROADS OR RUNWAYS OR IN BUILDING OPERATIONS INCLUDING LAVING DOWN UNDERGROUND ELECTRIC, WIRELESS, RADIO, TELEVISION, TELEPHONE,TELEGRAPH AND OVERSEAS COMMUNICATION CABLES AND SIMILAR OTHER UNDERGROUND CABLING WORK, ELECTRIC LINES, WATER SUPPLY LINES AND SEWERAGE PIPE LINES.

Therefore, the minimum rates of wages including the basic rates and Variable Dearness Allowance payable w.e.f. 01.10.2017 to the employees would be same as under:-

and any other categories of workers by whatever name they are called. which arc highly skilled.

Explanation: Fur the purposes of this notification

(a) the minimum rates of wages shall consist of all inclusive rates  including the bask rates, the cost of living allowance. namely, special allowance and the cash value of the concessional supply, if any of essential commodities;

(b) the minimum rates of wages includes the’wages for weekly day of rest;

(c) the minimum-rates of wages shall apply to employees engaged by contractors also;

(d) the minimum rates of wages for disabled persons shall be the same as payable to the workers of the appropriate category:

(c) (i) “unskilled work” means work which involves simple operations requiring little or no skill or experience on the job;

(iii “semi-skilled work” means work which involves sonic degree of skill or competence acquired through experience on the jut) which is capable of being performed under the supervision or guidance of a skilled employee and includes supervisory work;

(iii) “skilled work” means work which involves skill or competence acquired through experience on the job or through ruining, as an apprentice  in a technical vocational institute nail and the performance of which calls for initiative and judgment;

(v) “miner- Means a worker who is directly involvedorengaged in excavation or extraction byway of digging, picking, suiting. creasing. procession and loading and other incidental works thereto in a mine: and

(v) “highly skilled work” means work which calls for a high degree of perfection and full competence in the performance of certain task acquired through intensive technical or professional training or practical work experience for long years and also acquires of u worker to assume full responsibility for his judgment or decision involves in the execution of these tasks;

(f)  a person working or employed in or in connection with a mine is said eta be working or employed “below ground” if he is working or employed.-

(i)            in a shaft which has been or in the course of being sunk; or

(ii)           in any excavation which extends below superjuccni ground; or

(iii)          in an open cast working in which the depth of the excavation measured from its highest to its lowest point exceeds six metes:

(g)    where the existing rates or wages of any employee, based on contract  or agreement or otherwise site higher than the rates notified, the higher rates shall he protected and [reined as the minimum rates of wages for purpose of this notification.

(h)          where in any urea the minimum rates of wages fixed by this notification are lower than the minimum rates of wages fried by the state government Employees of  the aforesaid Employments in mania) to While the State Government is the appropriate Government. the rates of wages fixed by the Suite Government shall in respect of these areas, be deemed lo be the minimum rates of wages payable under this notification;
