Minutes of the meeting held under the chairmanship of Shri Bhanu Pratap Sharma, Secretary, DOP&T on 21.09.2016 to consider the cases of inter cadre deputation/inter cadre transfer/ overstayal of inter cadre deputation requiring relaxation of provisions(s) of the guidelines.

A meeting was held on 21.09.2016 under the Chairmanship of Secretary(P) to consider the cases of inter cadre deputation/inter cadre transfer/overstayal in inter cadre deputation period requiring relaxation of provision(s) of the guidelines. The members of the committee EO&AS & AS(S&V) were also present. Further US(S-III) was also present to assist the Committee in the meeting.

The Committee took note of the Action Taken Report on the minutes of the previous meeting held on 12.08.2016. The Committee after detailed deliberations and careful consideration in each case took following decisions in the meeting:-

Case 1: Inter cadre deputation of Ms. Punam, IAS (RJ:05) from Rajasthan cadre to Bihar cadre

The Committee was informed that Ms.Punam, IAS (RJ:05) being an officer of batch 2005 has completed the required service of nine years in her cadre and has not reached super time scale. Further, both the State Governments i.e. Rajasthan and Bihar have conveyed consent/ no objection for inter cadre deputation of the officer. The Committee after detailed deliberations recommended the proposal and directed to put up ACC note for the approval of ACC through MOS (PP).

Case 2: Cadre transfer of Shri Ajay Arora, IAS (MN:16) on grounds of PH policy dated 14.02.2014 [visual disability]

Case 3: Cadre transfer of Shri Sridhar Chamakuri, IAS (KL: 16) on grounds of PH policy dated 14.02.2014 [locomotor disability]

Case 4: Cadre transfer of Shri Rohitashva Singh Tomar, IAS (TR:2016) from Tripura cadre on grounds of PH policy dated 14.02.2014 [locomotor Disability]

In respect of cases 2 to 4, the Committee was informed that these officers have requested for cadre transfer on grounds of PH policy dated 14.02.2014. the officers have been appointed against vacancies reserved for Physically Handicapped Category. The Committee after detailed deliberations recommended processing of the proposals of cadre transfer of the officers and directed to seek comments/consent from the concerned State Governments and vigilance status of the officers. On receipt of same, the proposals along with ACC note may be put up for the approval of ACC through MOS(PP).

Case 5: Inter-cadre deputation of Shri Bhaskar Jyoti Sharma, IAS (OR:1999) and Smt. Shubha Sharma, IAS (OR:1999) from Odisha cadre to Assam Segment of Assam-Meghalaya Joint cadre.
The Committee was informed that the officers have requested for inter cadre deputation to Assam cadre. The Committee observed that the proposal needs relaxation of policy in respect of cooling off period. The Committee did not recommend the proposal as no strong reasons have been given for relaxation of cooling off and decided to incorporate the case in the quarterly report to be submitted to ACC and officer to be informed about the above decision.

Case 6: Overstayal of inter cadre deputation period by Dr K H Govinda Raj IAS (MH:95) to Karnataka cadre from 05/10/2012 to 04/09/2013

Case 7: Overstayal of inter cadre deputation period by Shri Ajoy Sharma, IAS (PB:99) to AGMUT cadre (Chandigarh Admn) from 21.08.2012 to 30.08.2013

Case 8: Overstayal of inter cadre deputation period by Shri D.K. Tiwari, IAS (PB:94) to AGMUT cadre (Chandigarh Admn) from 03.01.2012 to 31.07.2013

Case 9: Overstayal of inter cadre deputation period by Shri Sanoj Kumar Jha, IAS (SK:97) to Jharkhand cadre from 27.11.2005 to 02.08.2006

Case 10. Overstayal of inter cadre deputation period by Shri Arun Kumar Sinha, IAS (MT:99) to Jharkhand cadre from 15.09.2011 to 06.04.2012

Case 11: Overstayal of inter cadre deputation period by Shri Laima Chozah, IAS (WB:88) to AGMUT cadre (Mizoram segment) from 08.03.2000 to 27.05.2004

In respect of cases 6 to 11, the Committee observed that they do not seem to be under the ambit of the Committee. The committee noted that in all the above cases, ACC had earlier decided not to regularize overstayal period and had asked for action against them. If it is felt that in any of the above cases, there is any justification to resubmit the file, it may be put up to MOS(PP) through EO/Secretary(P).
