Setting up of Anomaly Committee to settle the Anomalies arising out of the implementation of the Seventh Pay Commission’s recommendations

OFFICE MEMORANDUM

Subject: Setting up of Anomaly Committee to settle the Anomalies arising out of the implementation of the Seventh Pay Commission’s recommendations.

The undersigned is directed to say that it has been decided that Anomaly Committees should be set up, consisting of representatives of the Officials Side and the Staff Side to settle the anomalies arising out of the implementation of the 7th Pay Commission’s recommendations, subject to the following conditions, namely:

(1) Definition of Anomaly
Anomaly will include the following cases:

(a) where the Official Side and the Staff Side are of the opinion that any recommendation is in contravention of the principle or the policy enunciated by the Seventh Central Pay Commission itself without the Commission assigning any reason; and

(b) where the maximum of the Level in the Pay Matrix corresponding to the applicable Grade Pay in the Pay Band under the pre-revised structure, as notified vide CCS (RP) Rules 2016, is less than the amount an employee is entitled to be fixed at, as per the formula for fixation of pay contained in the said Rules”.

(2) Composition:
There will be two levels of Anomaly Committees, National and Departmental, consisting of representatives of the Official Side and the Staff Side of the National Council and the Departmental Council respectively.

(3) The Departmental Anomaly Committee may be chaired by the Additional Secretary (Admn.) or the Joint Secretary (Admn.), if there is no post of Additional Secretary (Admn.). Financial Adviser of the Ministry / Department shall be one of the Member of the Departmental Anomaly Committee.

(4) The National Anomaly Committee will deal with anomalies common to two or more Departments and in respect of common categories of employees. The Departmental Anomaly Committee will deal with anomalies pertaining exclusively to the Department concerned and having no repercussions on the employees of another Ministry / Department in the opinion of the Financial Adviser.

(5) The Anomaly Committee shall receive anomalies through Secretary,Staff Side of respective Council upto six months from the date of its constitution and it will finally dispose of all the anomalies within a period of one year from the date of its constitution. Any recommendations of the Anomaly Committee to resolve the anomaly shall be subject to the approval of the Government.

(6) Cases where there is a dispute about the definition of “anomaly” and those where there is a disagreement between the Staff Side and the Official Side on the anomaly will be referred to and “Arbitrator” to be appointed out of a panel of names proposed by the two sides. However, this arbitration will not be a part of the JCM Scheme.

(7) The Arbitrator so appointed shall consider the disputed cases arising in the Anomaly Committees at the National as well as Department level.

(8) Orders regarding appointment of the Arbitrator and constitution of Anomaly Committee at National Level will be issued separately.All Ministries / Departments are accordingly requested to take urgent action to set up the Anomaly Committees for settlement of anomalies arising out of implementation of the 7th Pay Commission’s recommendations, as stipulated above.

    First of all, I earnest request is to remove the difference/parity of Pay Scales between CSS Cadre Stenographers and All India Subordinate Cadre Ministerial Staff Stenographers, which is the long pending issue since 01/01/1986, i.e., from the date of implementation of IV CPC.

    I retired wef 29.03.1993. The 6th pay commission had given much benefits to serving employees by recommending time bound promotion and also by awarding ACPs. However, it did not give a fair deal to the people retired before 2006. The 7th PC was fair in dealing with pre 2006 retirees by recommending Options 1 & 2 for calculating admissible pension which would have brought the pre 2006 retirees at par with post 2006 retirees to a great extent. I had got 17 increments in my last post before my retirement. I would benefit much by accepting option 1 recommended by 7th PC.The Govt should not let down the pre 2006 retirees by keeping the option 1 as recommended by 7th PC in pending. If verification of services and number of increments of the affected pensioners is difficult for the Regional P&A Offices, the individual pensioner may be given the responsibility to get the copies of relevant pages of his service book attested by the concerned Directorates and submit them to RP&AO, to ease the job of RP&AOs. As of now, it is learnt that, a committee of Secretaries is examining the feasibility of implementing the Option 1 recommendation of 7th PC. The committee should not disappoint the pre 2006 retirees as the Govt is keen to implement OROP.

    In continuation to above kindly issue orders for 7th CPC fixation of 1/3rd in the same proportion as it was in earlier. Which can be obtained by deducting 2/3rd of the pre-revised FULL pension from the revised Full pension as per 7th CPC recommendations.

    so far pensioners are concerned the committee has to address the following two main issues to remove the anomaly already existing and to avoid future anomaly 1)to all,ow 50% of last pay drawn or 50% of last 10 months average emoluments whichever is higher to pre-2006 retirees also 2) in the option now under consideration “the words “increments drawn in the retired grade” have to be replaced with the words “notional increments he would have drawn to arrive at that stage from which he retired “:(as otherwise his juniors retired in lower grade after long years of services would be getting more pension than the employee who retired from promoted grade before drawing any increment)

    Sir,
    If the option 1 recommended by 7th PC ( re-fixing pension considering the number of increments earned in the post held at the time of retirement) is not implemented, people like me will be very much disappointed. As of now, people who were much juniors to me are getting pension almost double to the amount that I get, as I am a pre 1996 retiree. If option 1 is implemented, my pension would get enhanced to a decent level as I got 17 increments in my last post.

    There was also ANAMOLIES at the time of implementation of 6th pay commission , When the govt of India set up a anamoly commission in 2008 to look into the grievance of Central Govt Employees but nothing tangible came out & sadly enough the JUNIORS received higher pay than SENIORS instead of the fact except similiar pay scale/ Posts as well as same qualification , It shall be a travesty of truth to state here the JUNIORS had put lesser number of years in Central Govt Service still the Junior received more salay which is a slap on the face of Senior Employees who had put more years of dedicated service & got frustrated This has happened in Central Silk Board , Ministry of Textiles. & at the time of retirement the Retiree got less pension . I request your good self to rectify the same in 7th Pay Commission. Further I may draw your kind attention of the fact that I joined CENTRAL SILK BOARD , MINISTRY OF TEXTILES on 14/10/1977 as STA , I was supposed to receive my 3rd Financial Upgradation after putting 30 years of uninterrupted service in Central Government (MODIFIED ASSURED CAREER PROGRESSION SCHEME BENEFITS) MACP in year 2007 but sadly enough , The benefits accruing to me on this account was given to me only in year 2011 , There was delay of more than 3 years & 2 months for giving me benefits – Whether this is intentional or unintentional Only My Department which is CENTRAL SILK BOARD , MINISTRY OF TEXTILES; Where I have put more than 35 years of uninterrupted Sevice with a dedicated mind & I am not able to understand that under which clause the department followed the rules for me in respect of denial of 3rd financial upgradation MACP scheme benefits in year 2007. I hope your good self shall follow this particular case through all angles. Thanking you Sir in anticipation.

    1)as already detailed the wording i the option given to retired e employees needs a change,as otherwise a person got promoted after long years of service in lower grade and retired in higher grade before drawing any increment is likely to get lesser pension than what he would get had he not been promoted. In other Words his juniors i n lower grade gets more pension than hi m because of his short term promotion, (2) secondly the pyre of Ravanabrahma is still smoulding as no step has been taken in case of pre 2006 retirees whose pension was fixed (eventhough they completed m ore than 33 years of service) at 50% of average emoluments(Not last pay drawn) which was less than last pay drawn) Hope the new committee coming would take these points for considedration

    Pension anomaly – fixation of pension of Pre 2006 retiree of scale 5500 -175-9000 as per 7 increments in pay band 9300-34800 grade pay 4200 matrix table pension is fixed at notional pay 43600 i.e. 21800 as pension whereas,
    junior retiree having scale 5000 –150 8000 and ten increments in pay band 9300 -34800 grade pay 4200 is fixed at notional pay 47600 i.e.23800 pension.
    Pl clarify or stepping of action be taken.

    I voluntarily retired in 1983 and a special pay for work of hindi library was counted as part of emoluments for purpose of pension, but in ivth cpc there was no mention of special pay hence my pension was reduced inv pay commission but what i was getting was protected. In 6th cpc my pension was redused with the argument that there was no mention of special pay in vi, v and vi pa y commissions. What should i do now.

    About increment in retired level will consider for notional pay alias pay fixation.

    Now the point is precious and valid that who was retired in the year 1985 after serving 40 years 7 months, then how many number of increments would count? Is it 40 or 41 or what?

    Who will raise this big point of anomaly and how the way it will be resolved asap?

    W.r.to Anamalities committee, there is no mention of fitment fomulae. I think govt is not in a mood to look into it. It is high time NCJA should take a firm stand on their earlier demands. To dilute the issue the Govt is disbursing salaries in a hurry as per7 CPC

    I have some doubt on 7th pay commission option 1 how this can be applied on pre 1996 retiree when there was no provision of MACP was applicable. A person joined the posts and retired in the same after having 33 or more service in the same post would he get 33 or more increments, If so a great diffrence will occured. will you please intimate to whom I can explian in detail.

    Committee to settle a commission to settle a committee report to review a committee report a settlement committee , to settle anomaly definitely a committee and finally a definition of anomaly is very much required , get that some big post dy.secretary/joint secretary/under secretary IAS officers have to be engaged.
    Our beloved Mr. Modi and sree sree Arun jettly team leaving no stone unturned to even trying to collect/snatch taxes from a beggar on the street leaving in India to earn revenue , why any economic expert may be better than Dr. Monomohan Singh and noble laureate Professor Amortya Sen advice these so called selfstyled Bharat Premees to think about unnecessary expanditure of exchquer of unnecessary created work load and every minute on all media tv advertising of swachha Bharat, digital India bla bla bla…
