Fixation of pay of persons transferred to the Dominion of India after 16.8.47

Subject:- Fixation of pay of persons transferred to the Dominion of India after 16.8.47.

A question has been raised as to how the pay of a person who opted service under the Dominion of India but whose services were retained by the Government of Pakistan should be fixed on his transfer to the Dominion of India after the 16th August 1947. The undersigned is directed to say that such a person is treated as an employee of the Dominion of India lent to the Government of Pakistan from the date of partition. On his transfer to the Dominion of India his pay, should, therefore, be fixed in accordance with the Central Civil Services (Revision of Pay) Rules, 1947, and he would be eligible for the arrears of pay and dearness allowance due for the period from the 1st January 1947 to the date of transfer.

2. It has also been dedicated that the pay of a Government servant who provisionally opted for service under Pakistan Government and was transferred to the Dominion of India after the 16th August 1947 due to change in option should be fixed under the rules referred to as if he was in the employment of the Dominion of India on the 16th August 1947 but no adjustments will be made in respect of pay or dearness allowance drawn by him prior to the transfer.
