Fixation of pay of Government servants under F.R. 22-C

OFFICE MEMORANDUM

Subject :- Fixation of pay of Government servants under F.R. 22-C.

The undersigned is directed to say that a doubt has been raised whether the provisions of F.R.22-C would be attracted in the case of a Government servant who had held the higher post on some previous occasion/occasions and was in receipt of pay higher than that to which he is entitled under F.R. 22-C, on his re-promotion to the same higher post, or whether the pay in such case would be fixed in accordance with the proviso to F.R.22.

2. The President is pleased to decide that the pay of Government servants on promotion to higher posts (upto the level of promotions from class II to class I) from 1-4-1961, is strictly required to be fixed under the provisions of F.R. 22-C. Their pay cannot be fixed under F.R. 22 if the same happens to be more advantageous than the pay fixed considered for protection of pay drawn on a previous occasion in the same post on the analogy of proviso to F.R. 22 and pay fixed under F.R. 27.
