Anomaly arising out of the application of rule 10 of the Central Civil Services (Revision of Pay) Rules, 1947

 OFFICE MEMORANDUM

 Subject:- Anomaly arising out of the application of rule 10 of the Central Civil Services (Revision of Pay) Rules, 1947.

 The undersigned is directed to say that cases have arisen in which pay of persons in the same grade drawing different rates of pay in the existing scale has been fixed at the same stage in the prescribed scale and under the operation of rule 10 of the Central Civil Services (Revision of Pay) Rules, 1947, juniors among them happen to draw the next increment in the prescribed scale earlier than their seniors.  In order to obviate this anomaly it has been decided that in the case of a person who draws on refixation of pay under those rules the initial stage of the prescribed scale, the date of next increment in that scale should be the date when an increment will ordinarily fall due in that scale and not the date of increment in the existing scale.

 2. These orders apply from the date from which the government servant concerned elects the prescribed scale and the date of his next increment in that scale should be refixed accordingly. The recovery of amounts overdrawn in such cases upto the date of issue of these orders will be waived.

 3. The necessary amendment in the Central Civil Services (Revision of Pay) Rules, 1947, will be made in due course.
