Pre-2006 Pensioners to get arrears from 1.1.2006

UOI SLP against Pre-2006 Pensioners dismissed by Supreme Court.

The Supreme Court has dismissed the SLP (Civil) 23055/2013 filed by Union of India against Delhi High Court judgement in pre-2006 pensioners casein WP 1535/2012 upholding the CAT PB judgement and Delhi High Court judgement. The above SLP came up for hearing on 29/7/2013 and the apex court dismissed the SLP on the same day.

Pensioners will now get arrears w.e.f. 1/1/2006 if their revised pension was fixed at less than 50% percent of the minimum of the pay in the pay band including grade pay thereon in the revised scale corresponding  to the pre-revised pay scale from which the pensioner has retired.

JUDGEMENT :

UPON hearing counsel the Court made the following order :
“We are not inclined to interfere with the order passed by the High Court. Consequently, the special leave petitions are dismissed. However, the petitioners are at liberty to raise all points before the Tribunal as and when the appeal”.

    We have lost patience. God The court gave 4 months time which too is likely to be over. knows when the GOI will accept th Honble Supreme Court Order.May I know the latest position

    Congress led UPA govt do really respect the law & court / justice. For pre 2006 pensioners it is more lawful @ respect ful also.

    The ill fated pre-2006 pensioners seem to have fallen into a ‘locked horns’ situation with the GOI. Even the verdicts of Honorable Courts have not been able to unlock the ‘locked’situation. God bless the veteran retirees for to be patient and positive towards our demand and also bless the functionaries of GOI for to be more considerate, more positive and more decisive towards this elongated issue to end this ‘horns of dilemma’ situation. My sincere thanks to all the veterans who have been persuading the GOI with their worthwhile views and comments on the issue.

    DEAR ALL,MY FATHER EXPIRED ON 7/6/2008 ,HE RETIRED FROM IAF IN 1994 AS JWO X GROUP AFTER29 YRS OF SERVICE ,HIS DOB IS 14/11/1946.AFTER HIS DEATH MY MOTHER RECEIVED FAMILY PENSION @5370 PM BASIC PM AS ENHANCE RATE OF FAMILY PENSION ,AFTER 14/11/2011 HER PENSION REDUCED TO 5070 AS NORMAL RATE, WHAT IS LOGIC OF ENHANCE RATE AND NORMAL RATE EVEN TODAY I DONT UNDERSTAND. NOW AFTER IMPLITATION OF CIRCULAR 502 &CIR 494 REGARDING ENHANCEMENT IN FAMILY PENSION SHE IS UNABLE TO GOT HER ARREARS AFTER 9 MONTHS ,AFTER SENDING SO MANY LETTERS &MAILS TO RELATED OFFICES ,NO REPLY FROM THEIR SIDE . CAN ANY ONE PL PL PL HELP .THANKS IN ADVANCE.

    The Govt. next course of action is awaited. As per the judgement all retirees should get arrears from 01.01.2006. The Govt did approve .It was changed by officers at the lower level.We have been under the impression that the pension is always revised and paid correctly. Since the Govt. has made the disbursing AUTHORITIES to revise and pay is a big QUESTION to find MOTIVE behind? Who is playing this role and under whose instructions ? Is it not the duty of our Head of the service (R.O.)? It is Almighty GOD who looks after us. I request not to worry. The justice will prevail. I pray GOD to provide PEACE to the departed SOULS who could not enjoy the gift of the Government.Regards,

    my father was retired from army (ASC) 01/01/1985 he was expired on 11/08/2011 after that my mother started the family pension can he got the one rank one pension benfit my father was retired as sepoy after compeleted 16yrs. service please tell me can she took the benfit
