OFFICE MEMORANDUM

Subject:—Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same grade pay.

The undersigned is directed to invite an attention to the provisions contained in Rule 13 of the CCS(RP) Rules, 2008, which provides for the method of fixation of pay on promotion on or after 1.1.2006 in case, inter-alia, of promotion from one grade pay to another. The Rule provides for fixation of pay by way of addition of one increment equal to 3% of the sum of the pay in the pay band and the existing grade pay (rounded off to the next multiple of 10) to the existing pay in the pay band and then fixing the pay in the promotional post as per the procedure prescribed therein.

2.    In terms of this Ministry’s OM No. 169/2/2000-IC dated 24.11.2000, dealing with the situation whereby both the feeder and the promotional grades were placed in the identical revised pay scales based on the recommendations of the 5th Central Pay Commission, it was provided, inter-alia, that only in cases where it was not found feasible to appropriately restructure cadres in question on functional, operational and administrative considerations, extension of the benefit of fixation of pay under FR 22(I)(a)(1) could be considered on the merits of each case, provided all the conditions precedent for the grant of this benefit were fully satisfied and promotion to the post in question actually involved assumption of higher responsibilities.

3.    In view of the provisions which existed prior to 1.1.2006, the matter has been considered and the President is pleased to decide that in cases of promotion from one post to another where the promotional post carries the same Grade Pay as the feeder post, the fixation of pay in such cases will be done in the manner as prescribed in Rule 13(i) of the CCS(RP) Rules, 2008, provided fixation of pay in such cases was done prior to 1.1.2006 in terms of this Ministry’s aforesaid OM No. 169/2/2000-IC dated 24.11.2000.
 

4. In so far as the persons serving the Indian Audit and Account Department are concerned, these orders are issued in consultation with the Comptroller & Auditor General of India.

    I AM WORKING WITH THE INDIAN NAVY AS PS(GAZ). MY DETAILS ARE AS FOLLOWS:
    JOINED NAVY IN JAN 1994 AS STENO GR III. PROMOTED AS STENO GR II IN DEC 99. PROMOTED AS STENO GR I IN SEP 2006. PROMOTED AS PS (GAZ) IN MAY 2013.
    ORDER OF MERGING OF STENO II AND STENO I CAME IN APR 2010. WHEN I WAS PROMOTED AS GR. I IN SEP 06, INITIALLY MY PAY WAS FIXED AS PER 5TH CPC. THEN WHEN 6TH CPC CAME MY PAY WAS FIXED ACCORDINGLY. NOW WHEN I GOT PROMOTED TO PS (G) IN MAY 2013, THE OFFICE IS SAYING THAT BECAUSE STENO II AND STENO I IS MERGED YOU WILL NOT GET THE PROMOTION OF GR I AND THIS PROMOTION WILL BE WAIVED OFF. AND DURING THE PAY FIXATION OF PS, THEY ARE RECOVERING MY PAY FROM THE DATE OF FIXATION OF GR I FROM SEP 06. I SHOWED THEM THE ORDER OF MoF ORDER NO. 10/02/2011.E.III/A DATED 07 JAN 13 STATING FIXATION OF PAY ON PROMOTION TO A POST CARRYING HIGHER DUTIES AND RESPONSIBILITIES BUT CARRYING THE SAME GRADE PAY. MY GP IN BOTH THE POST WAS RS. 4200. BUT CDA IS SAYING THAT GOVT HAS NOT CLARIFIED WHICH POSTS COMES UNDER HIGHER DUTIES AND REPONSIBILITES.
    PLS. TELL ME WHETHER MY PAY SHOULD BE RECOVERED OR NOT. PLS TELL WHICH POSTS COME UNDER HIGHER DUTIES AND RESPONSIBILITIES. PLS ALSO TELL ME IF THERE ARE ANY FURTHER MoF ORDERS ON THIS ISSUE.

    Dear Sir,
    happy to note the orders dtd 7.1.2013 regarding fixation of pay on promotion to a post carrying higher responsibilities. Here in the para 2 an OM dtd 24.11.2000 has been referred. Kindly cause to send the same to mail ID for clarification.
    IN the department of posts the prior to implementation of 6 CPC the TBOP scale and LSG scale were identical i.e 4500-125-6000. Whereas the TBOP is only financial upgradation and LSG is a promotion to a post carrying higher responsibility, kinldy clarify whether the orders dtd 7.1.13 read with 24.11.2000 can be implemented and pay fixed to a TBOP official promoted to LSG prior to 1.1.2006 also.

      Dear Sir,
      I also got promotion to LSG w.e.f 24.04.2004 after getting TBOP and no fixation was allowed. But subsequently I got HSG-II promotion w.e.f. 25.08.2008 and adhoc promotion to HSG-I w.e.f 14.07.2009 and took voluntary retirement w.e.f 01.09.2012. Lastly I worked as Postmaster, Trimulgherry HO, Secunderabad -15 ( A.P).Even during my HSG-II promotion I was not given any fixation benefit as I was given BCR w.e.f 1.1.2008 as drawing grade pay of Rs.4200/-. s per OM dtd 24.11.2000 all the norm based posts in the LSG/HSG-II/HSG-I cadre should have been identified as carrying higher duties and responsibilities but I am afraid whther this was done or not. We have to ascertain. I applied for fixation but the same was rejected by the Circle IFA.

    I am working with defence . I had joined in Dec 2005 in GP 6600/-. however in mar 2006 another officer had joined in the same GP 6600/-. But his basic pay is more then me by Rs 150/-. Pls clarify whether my pay will be step up.

    I am working as a PRT. I have got senior scale on 30 nov.2004 ie.5500-175-9000. In vi cpc my pay fixation as on jan.2006 is -11210 4600=15810. ButTGT whose pay scale also same . ie.5500-175-9000. on jan.2006 they have got minimum pay fixation 12540 4600=17140. So,my pay fixation is right or wrong?

    Sir, I am join drdo as a senior technical assistant ‘A’ by nov. 1999 in pay scale 5000-150-8000 and face assessment board in year 2005 after five year residencial period but not get promotion after one year i was got promotion in pay scale 5500-175-9000 as a senior technical assistant ‘B’ by date 01/09/2006. same day i was signed a documents about receive higher resposibilites that time i was choose option to pay fixation from my increment month november. As per 5th CPC my basic pay will fix from 5900 ( 5000-150-8000 ) to 6375 ( 5500-175-9000 )as on 1/11/2006. After 6th CPC my employer fix my salery as on 1/1/2000 5900 * 1.86 + 4200 grade pay and 3% annual increment give in july 2006 and also give 3% promotion increment with same grade pay. After more than two year my employer recovery 3% promotion increment without intimation also a order publish that say due to merger of pay scale 5000-150-8000 & 5500-175-9000 my promotion is null and wide. I was request for pay protection but not give any reply. In the light of latest order by min. of expenditure related with higher resposibilites. This is applicable for me or not, kindly give details.

    I was promoted as UDC, my PB was 6860+1900 (LDC) and with increase in 3% my pay was fixed to 7090+2400 as UDC, but the newly joined UDC get Pay in Pay Band of 7510+2400 why is it that the minimum Pay in pay band not fixed for promoted UDC as being in service for 6 years I am getting less pay than newly joined UDC in same grade pay.

    It is most unreasonable to insist that one should travel in Air India on LTC presumably to give life and energy to a sick or illmanaged govt. company. It should be limited or regulated to LTC-80 fare and should allow to travel in any flight of the choice and convenience of entitled Govt. Officer.

    The order released by Govt. on 07/01/2013 about fixation of on promotion to a post carrying higher duties & responsiblities but carrying the same grade pay should apply to teachers also under FR 22 (I)(a)(1)

    does the order released by Govt “Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same grade pay” apply to teachers who have been promoted from senior scale of T(P) / TGT / PGT to TGT / PGT or any higher post. The pay scales of teachers are as shown below:
    Basic grade senior grade selection grade
    T(P) 4200 4600 4800
    TGT 4600 4800 5400 (PB-2)
    PGT 4800 5400 (PB-3) 6600
    vice principal 5400 (PB-3) 6600
    Principal 7600
    for eg if a primary teacher who has got senior scale and is in the GP of 4600 if gets promoted to TGT in GP of 4600, would he get pay fixation benefit with one increment vide order No. 10/2/2011.E-III/A dt. 7/1/13. kindly elucidate. The teacher has not been given any benefit of increment during grant of senior scale.
