Outcome of the Meeting of Joint Committee on MACPS Anomalies 27/07/2012.

Sub: – Meeting of the Joint Committee on MACPS Anomalies

 

As decided in the National Anomaly Committee Meeting held on 17/07/2012,the Dop&T held separate meeting with the Leaders of Staff Side at North Block, New Delhi, Room No.190 on 27/07/2012. Shri M.Raghavaiah, General Secretary, NFIR has participated in the meeting.

Discussion were held on the following  issues

1. Grant of MACP in the promotional hierarchy:
The Staff Side (NFIR) insisted that option be given to individual employee in this regard to facilitate him/her to opt for availing benefit of financial upgradation.

After discussion it was agreed to examine in depth for finding solution



2. Date of effect of MACP Scheme
The desirability of giving effect to the MACP Scheme w.e.f.01/01/2006 will be examined.

 

3. Counting of total temporary status Casual Labour service for reckoning 10/20/30 years under MACP Scheme:
Official Sides tated that this will be processed separately.

 

4. Treatment of employees selected under LDCE/GDCE Scheme:
In the light of the instructions issued when the ACP Scheme was introduced,the same policy be adopted and accordingly orders will be issued.In other words,those inducted through LDCE/GDCE Scheme, such induction may be counted as appointment and will not be reckoned as promotion.

 

5. Problems faced in the identical Grade Pay:

It was agreed to issue instructions for granting additional increment for fixation of Pay in case of promotion to the same Grade Pay. Instructions in this regard will be issued to Ministry of Railways etc..

 

6. Financial Upgradation under MACPS, in the case of staff who joined another Unit/Organisation on request:

The Staff Side (NFIR) has pointed out that OM dated 01/11/2010 should be suitably amended covering the staff who were transferred on request on reversion to the Unit/Organisation so that the total service rendered in the previous Unit/Organisation may be counted for MACPS. It was agreed to consider

7. Extension of benefit of MACPS to an employee appointed in Grade where direct recruitment element is there while ignoring service and promotion rendered prior to his appointment in that post:

Official Side reiterated that suitable clarification N o.5 of OM dated 09/09/2010 was already issued.staff side stated that this will be checked up.

 

8. Stepping up of Pay of Senior incumbents at par with Junior incumbents as a consequence of ACP/MACPS:

Staff Side (NFIR) has explained the case of gross injustice done, more particularly in the Accounts Department of Indian Railways wherein the incumbents who cleared the Appendix examination are drawing less pay than those who could not qualify the said examination and got the benefit of MACPS. The staff side (NFIR) insisted that this situation is leading to de-motivation among the qualified staff and urged for rectifying the anomalies is. It was agreed to consider and Ministry of Railways advised to send the proposal

 

9. Employees who got one promotion prior to 01/09/2008 and completed over two decades of service without benefit of promotion and are denied third ACP under MACPS:

After discussion Official Side agreed that this is a peculiar situation and assured to take action for remedying the situation. The Staff Side (NFIR) has insisted that in such cases third ACP should be straight away given to the staff from the date subsequent to the date of completion of two decades of service after first promotion.
Official Side appreciated the logic and reasonableness and agreed to consider.

 

10. Modification of recruitment rules particularly in Railways and upgradation granted by abolition of Pay scale – Implementation of MACPS:

The Staff Side (NFIR) explained that in the Railways the lower Pay Scales were abolished and posts were upgraded to the higher Pay Scales with revision of recruitment qualification and designation. In such cases the Staff Side insisted that entry Grade Pay as a result of upgradation subsequent to abolition of lower Pay Scale  s should be taken into consideration for reckoning 10/20/30 years of service for granting MACP Official Side has agreed to obtain details from Ministry of Railways for issuing appropriate clarification. In the mean while,Railway Board will have discussion with the Staff Side separately so that appropriate proposal could be sent to the DoP&T.

 

11. Placement of staff as a result of upgradation of posts:
The Staff Side (NFIR) insisted that such placements should not be considered as promotion for the purpose of grant of financial upgradation under MACP Scheme. Official Side stated that this will be examined.

12. In the course of discussion the Official Side also stated that MACP Scheme should be a fall-back option and the Ministries should conduct Cadre Restructuring for ensuring that the staff could be promoted within the reasonable time i.e. within 10 years. When the Staff Side pointed out that the Ministry of Railways is citing the
instructions of Ministry of Finance issued some years back that only one third of the Cadre could be disturbed,for revising the percentages the Official Side clarified that necessary clarificatory instructions will be issued to the Ministry of Railways etc.,so that the Cadre Restructuring can be done without problems.

    IN VI NATIONAL ANAMOLY COMMITTEE IT WAS FANILISED TO GIVE NECESSARY INSTRUCTION TO GIVE ONE INCREMENT TO THOSE WHO WERE PROMOTED I N SAME GRADE PAY AS HIS RESPONSIBILITY RISES DUE TO PROMOTION. ONLY IN GRADE WHERE INCREMENT WERE GIVEN IN V CPC WHEN PROMOTED. IF A EMPLOYEE IN GRADE PAY RS.1800 POST PROMOTED IN SAME GRADE PAY RS.1800 POST AFTER 23 YEARS PROMOTED WITH 2 MACP BENEFIT WHILE HE GET BENEFIT OF THIS DECISION. WHAT ABOUT THE ORDER TILL DATE I.E(23/12/12) NO ORDER RELEASED. WHEN WILL IT BE RELEASED.

    Anamoly com. is reqested to look into the grievances of gp B officers in defence production est. where there are two scales i )74500-22511500 ii)7500-12000.An officer gets promotion in 1996 in Scale i) & and gets another promotion in 2002 in scale ii). He hangs within two scales till he retires in 2007 with around 11 yrs & gets grade pay of Rs4800 & his scale is the same as gp c employees. With Gazetted Officer’s duties & accountability Does he not deserve atleast Grade pay of class I ? He has rendered 40 yrs of service & getting a meagre Basic pension of Rs 13000. I request for taking up this anamoly to this forum, so that such officers may get their respectble due.

    Sir,
    I have joined the Delhi University in 1989 as JACT in the pay scale of 950-1500. Later on our pay scale was rationalised as 1200-2040 by the Executive Coucil since initial date of appointment. However, the cash benefit was granted w.e.f 27.08.1996. In 1997 I have been placed in the pay scale of 1400-2300(revised 4500-7000) under OTUM scheme. Till then I have not been granted any benefit of ACP or MACP. Whereas my collegues who have joined the services before 31.8.1988, are enjoying the grade pay of 4200. My request for benefit under MACP has been declined on the basis that the ACP and MACP schemes are different and the employees covered under ACP will be placed in the grade pay after 20 years, whereas, the employees covered under MACP will be placed in the grade pay after 28 years services. Why this discremination? Please clarify.

    there is a problem if an employee is without pay for a single day only between 1jan 2006 to 30 june 2006 ,he has to bear a loss of an year in his increament on the other hand if anyone is without pay for 179 days after 30 june 2006 there will be no loss .

    I have got two financial up-gradation under TBOP and BCR Scheme before 01.09.2008 i.e before implementation of MACP Scheme. Further in the month of Feb-2010, I have got first regular promotion in the grade pay of Rs.4800/-.The 30 years of service has been completed in the month of Oct-2011 .Kindly clarify whether I am entitled for third MACP in the next Grade pay of Rs.5400/-I have got two financial up-gradation under TBOP and BCR Scheme before 01.09.2008 i.e before implementation of MACP Scheme. Further in the month of Feb-2010, I have got first regular promotion in the grade pay of Rs.4800/-.The 30 years of service has been completed in the month of Oct-2011 .Kindly clarify whether I am entitled for third MACP in the next Grade pay of Rs.5400/-after completion of 30 years of service?
    In this connection clarification should be issued as in some offices confusion is created and denying the third financial up gradation after completion of 30 years of service.

    As the Orders of MACP were issued on 19.5.2009 giving retrospective effect from 1.9.2008, those employees who have completed 24 years of service during that period i.e. from 1.9.2008 to 19.5.2009 have to come under MACP, and they are not able to get the benefit of ACP (Official hierarchy). If the date of MACP is amended with prospective effect i.e. from 19.5.2009, these employees deprived of the benefits will also be considered favourably. Hence the Staff Side and the Official Side are requested to consider this anomaly sympathetically and issue necessary Orders suitably to cover those employees who fall between 1.9.2008 and 19.5.2009.

    Sir, I want to know the present position regarding MACP isues of jounior Engineers. wheater we are getting grade pay 4600 at startig 5400 at ten years, 6600 at 20 years and 7600 at 30 yaears or any thing other may be informed please.

    The financial up gradation under MACP Scheme should be strictly in the promotional hierarchy for proper benefit otherwise it should be called as ‘ Murdered-ACP ‘ Scheme.

    I WOULD LIKE TO EXPOSE THAT THE SKILLED WORKERS WORKING IN ORDNANCE AND ORDNANCE EQUIPMENT FACTORIES ARE ONLY GETTING RUPEES 100 ONLY FOR MACP BENEFIT AS PER THE GRADE PAY HIERARCHY, WHERE AS , IT HAS ALREADY BEEN PROVIDED PROMOTIONAL HIERARCHY IN THE 5 TH PAY COMMISSION. ANOTHER THING THOSE WHO HAVE GRANTED GP 2400 IN BETWEEN 1.1.2006 TO 1.9.2008 AS OLD ACP IN COMPLETION OF 12 YEARS ,THEIR GP WAS REDUCED TO GP 2000 IS VERY PATHETIC. THEREFORE THOSE THINGS HAVE TO BE HIGHLIGHTED. THEIR GRADE PAY TO BE RESTORED.

    Clarification: Regarding MACP – Joined the Railways in 1982 December as apprentice Chargeman and absorbed as JE-II in January, 1985. As per VI Pay Commission, I got my first promotion in Sept.1991 with Grade Pay 4600/- and got my second MACP on 1.9.2008 with Grade Pay 4800/-. Now on 1.7.11 I have completed 20 years from my first promotion. Am I not eligible for my III MACP on 1.7.11? i.e. completion of 20 years from my first promotion. Kindly clarify. Thank you.

    In ordnance factories (MIN. OF DEFENCE), particularly in CHARGEMAN(T/NT) CADRE ,All the employees in this cadre must get MACP in Promotional Hierarchy instead of Grade Pay Hierarchy.So within a span 30 years of service all the employees in CHARGEMAN(T/NT) CADRE must get
    FIRST MACP(10 years) GP Rs.4600/- in PB2.
    SECOND MACP (20 years) GP Rs.5400/- in PB3.
    THIRD MACP (30 years) GP Rs.6600/- in PB4.
    Sothat vested right of ALL EMPLOYESS IN CHARGEMAN(T/NT) CADRE are tobe maintain & they are motivated towards their duties in differents areas where they are working.
    It is humble request from ALL EMPLOYESS IN CHARGEMAN(T/NT) CADRE TO ANOMOLY COMMOTTE to get MACP in Promotional Hierarchy .

    Problems faced in the identical Grade Pay:

    Please issue the order for railway and defence also, otherwise the employees of railway and the soldiers of the armed forces will not be benefited.

    Why you are mentioning the identical grade pay. Some employees are gettting 2nd or 3rd ACP in the armed forces. But they are getting 1st promotion.

    For example : He is taking 2nd ACP of Grade pay Rs. 4600/- after completion of more than 20 years service. But he got the 1st promotion of grade pay 4200/- after completion of 22 years of service . Then issue the order that He should get the one promotion increment while getting the 1st promotion even his grade pay is not identical.

    You are kindly requested to clarify this point in also in the detailed letter.

    Will the NAC will consider Promotional Hierarchy instead of Grade Pay Hierarchy and if so when are the order expected
