Tamil Nadu Leave Rules – Maternity Leave – Enhancement of Maternity Leave to 180 days – Orders – Issued.


PERSONNEL AND ADMINISTRATIVE REFORMS (FR.III) DEPARTMENT

Read:

(1) G.O.(Ms) No.279, Personnel and Administrative Reforms (FR.II) Department, dated 11.03.1980.

(2) G.O.(Ms) No.138, Personnel and Administrative Reforms (FR.III) Department, dated 26.02.1983.

(3) G.O.(Ms) No.237, Personnel and Administrative Reforms (FR.III) Department, dated 29.06.1993.

ORDER:-

   In the Government Order 1st read above, the Maternity Leave admissible to married women Government Servants was enhanced to 90 days which may be spread over from the pre-confinement rest to post-confinement recuperation at the option of the Government Employee. It was also ordered therein that the Maternity Leave will not be admissible to women Government Servants with more than three children. Further, in the Government Order 2nd read above, necessary amendments to Rule 101(a) of the Fundamental Rules were issued, based on the executive orders issued in the Government Order 1st read above. Based on the recommendation of the Tamil Nadu third pay commission and on par with Central Government Employees, orders were issued in the Government Order 3rd read above to the effect that a woman Government Servant with less than two surviving children be allowed Maternity Leave for a period of 90 days from the date of its commencement.

   2. The Government after careful consideration direct that the Maternity Leave admissible to married women Government Servants which is 90 days at present be enhanced to 180 days which may be spread over from the pre-confinement rest to post-confinement recuperation at the option of the woman Government Servant. The Maternity Leave will be admissible to married women Government Servants with less than two surviving Children.

   3. Necessary amendments to Fundamental Rules will be issued separately.

    1) Can you please confirm this 180 days Maternity leave is applicable for government servants only or for all Non government(Private & MNC’s) servants.

    2)ML is applicable for all means, If the company not follows these GO means what we have to do?

    Madam you are entitled for maternity leave even in the probationary period. As per G.O.Ms.No.138 Personnel and Administrative department dated 26.02.1983 and Govt Letter No.44189/82-13, P & A R dated 16.12.1983. But after deducting the available earned leave from the maternity leave remaining days can be availed. For non permanet government servants they must have completed one year of service to avail the maternity benefit further clarification we can see Rule 101 A of Fundamental rules for Tamilnadu.

My probationary period is not yet completed. doctor have advised me to take complete bed rest from 1st month to delivery. 6months period is remaining to complete my probationary period. can i avail my maternity leave from 1st month of my pregnancy onwards?

    Hello sir. My wife is a secondary grade teacher appointed on 17-12-2012 in a government school. She took maternity leave from 1-2-2013 to 29-7-2013 (179 days )before completing probation period. She didn’t receive her salary during the leave period. I want to know whether she is eligible to claim her maternity leave salary before completing her probation period. Please tell me the TN GO regarding this matter. My wife didn’t take E.L. in 2013. Please explain.

    My Wife was working as BT Asst. She was joined in the date of 12-Dec-2012.The probation period was mentioned as 2 years, since still she is in the probation period
    wheather she is eligible to take the maternity leave with pay. If yes, kindly please let us know how many days she can take leave and please let us know the Government Order number for this. Thanks.

    Hello,
    my wife is expecting the 2nd child on next week(28.08.13), and she was slected as a BT Govt teacher through TET in tamilnadu, and she has been started the service from 16.12.12. which means she is in probation period and served only 8months till date, whether can she shall eligible of Maternity leave(180days) with salary. if so what frequency she will get the salry(i.e. every month or after ending of 6months matenity Leave)….
    Note:- can these 6months will be added in to probation period..

    My wife is 6 months pregnant. She is working as a school teacher . Already we have two children. This is the third pregnancy. She has not availed for maternity leave for the previous two deliveries, because she got the job only after the second delivery. Is she eligible for maternity leave for this third delivery?     3. Leave for adoption
    If a woman employee adopts a child, she is eligible for leave as indicated below subject to the following conditions – G.O.Ms. No.342, Social Welfare, dt. 08.12.95 and government Lr.No.21559/SW-V/96-3 social welfare dt.14.02.97 (Leave for this purpose means eligible leave and not maternity leave – Author)
    (i) The women employee concerned should have two or less children
    (ii) The maximum admissible leave is one year. Medical certificate is not necessary. The
    leave will be as issustrated below.
    * If the age of the adopted child is less than one month. Leave up to one year be allowed.
    * If the age of the child is nine months or more. Leave up to three months be allowed.
    * That is, she is eligible for a maximum of one year leave excluding the completed months of the baby.
    (iii) She may be given any eligible leave. (That is earned leave, U.E.L. On private affairs etc)
    (iv) A certificate from a recognised voluntary institution stating that the applicant has legally adopted the child should be produced.

    2.Natural abortion or voluntary abortion
    (F.R.101(a) & G.O.Ms.No. 1190, P&A.R.dated 25.10.1978)
    (1) Married woman employees may be sanctioned maternity leave in case of
    miscarrying or abortion or medical termination of pregnancy irrespective of the number of abortions.
    Sterlisation is also not necessary – G.O.Ms.No.237 P&A.R.dt. 29.6.93. Medical termination of Pregnancy Author)
    (2) The period of leave shall be for six weeks from the date of abortion or medical termination of Pregnancy
    (3) The condition to sanction this leave is that abortion or medical termination of pregnancy should have taken place after 12 weeks but before 20 weeks of pregnancy. The termination of pregnancy should have been performed in government Hospitals or other institutions approved under the Medical Termination of preganancy Act, 1971 – G.O. Ms.No.1190, P&A.R. Dated 25.10.1978.
    (4) The certificate issued by a registered Medical practitioner authorised under the Medical Termination of pregnancy Act may also be accepted for this purpose – G.O. Ms.No 1684, Health and Family Welfare, dated 21.07.1977.
    (5) In respect of Temporary employees, the available E.L. At credit shall first be allowed and balance sanctioned as Maternity Leave. Sivaramakrishnan R 9600802508

    You have told that you are working as asst surgeon under 10 a 1 and completed one year and required regarding maternity leaveeligibility.

    Temporary women employees are also eligible for maternity leave provided that
    (a) Temporary women employees may also be given Maternity Leave but only after
    completing one year service.
    (b) In their cases, the E.L. available at the credit shall first be sanctioned and the balance
    sanctioned as Maternity leave.
    (c) other conditions are the same as applicable to regular government
    employees-A.r 101(a) as introduced in G.o. MS.NO.138, P&A.R. dated 26.2.1983. Sivaramakrishnan. R 9600802508

    Good Morning Sir!
    My wife is working in TN Govt high school as teacher and she has taken maternity leave for her 2nd child (after completing 6 months) during her prabation period for 82 days (after deducting E/L). She didnt get pay at tht time(for above period). Now she completed prabation and regularised. But now she is denied pay for the above period (loss of pay) and told that her 2nd increment will also be delayed by 82 days. pls send me the TN GO which clears all these doubts so that my gets all her benebits.

Due to her poverty, she wants her salary in the ending month itself.Please clarify whether she will be payable her salary in the ending of every month itself or only at end of the sixth month i.e closing of her last maternity leave month?

    My wife is 7 months pregnant. She is working as an assistant professor. Already we have two children. This is the third pregnancy. She has not availed for maternity leave for the previous two deliveries, because she got the job only after the second delivery. Is she eligible for maternity leave for this third delivery?     i am working as a BT assistant in GHS AT Coimbatore.i delivered a baby on march 19th 2012.but i applied medical leave from 5th march to 18th march 2012 and maternity leave from 19th march to 14th sep 2012.(180days).now my doubt is whether i can avail both the medical leave and maternity leave coimbinedly or not.please clarify my doubt soon.

    As per G.O. Ms. No. 61 Personnel and Administrative Reforms (FR III) Department dated 16.06.2011, THE WOMEN GOVERNMENT SERVANTS WHO WERE ON MATERNITY LEAVE, PRIOR TO THE ISSUE OF THE ABOVE SAID GOVERNMENT ORDER NO. 51 P & A. R DATED 16.05.2011, AND CONTINUING THAT LEAVE ON OR AFTER 15.05.2011 ARE ALSO ELIGIBLE FOR EXTENDING THEIR MATERNITY LEAVE FOR SIX MONTHS.

    2. The leave can be availed from the pre confinement rest to post confinement recuperation at the option of the woman Government servant

    3. The Women Government employees who have not completed the period of probation are also eligible. But the earned leave at their credit as on the date of going on leave will be debited first and the remaining days will be treated as Maternity Leave. For example if a Government servant is having 11 days of Earned Leave at her credit as on the date in which she goes on maternity leave, 11 days of Earned Leave and 169 days of Maternity leave may be sanctioned to her.

    The Women Government Employee appointed under Rule 10 (a) (i) are eligible for Maternity Leave only after completion of period of one year without any break.

    Regular Government staff nurse are also eligible for maternity Leave and eligible for salary

    Sir I am working as a typist. Before probation declaration i went on maternity leave for 30 days. For declaring probation except Casual leave all the other leaves should be included or not. Kindly give me the correct rules.

    My wife is working as a teacher in Govt. model school. She had a delivery on March 2011 and applied maternity benefits for 90 days but the tamil nadu govenment passed the G.O No. 51 on May 2011 enhanced to 180 days. We wish to know whether she is eligible 90 days or 180 days. Please clarify.
