Child Care Leave for Central Government employees – Clarification

Office Memorandum

  • Sub: Child Care Leave in respect of Central Government employees as a result of Sixth Central Pay Commission recommendations – Clarification regarding

The undersigned is directed to say that this Department has been receiving representations from Government Servants through various quarters like the Public Grievances Cell/Associations etc requesting to review the decision to allow Child Care Leave (CCL) only if the employee has no E.L. at her credit.

2. This Department’s O.M. No.13018/2/2008-Estt.(L) dated 11/09/2008 regarding introduction of Child Care Leave in respect of Central Government employees and subsequent clarifications vide O.Ms. dated 29/9/2008, 18/11/2008 and 2/12/2008 were reviewed.

It has now been decided in consultation with Department of Expenditure, to delete the condition that CCL can be availed only if the employee concerned has no Earned Leave at her credit, subject to the following conditions:-

(i) CCL may not be granted in more than 3 spells in a calendar year.

(ii) CCL may not be granted for less than 15 days.

(iii) CCL should not ordinarily be granted during the probation period except in case of certain extreme situations where the leave sanctioning authority is fully satisfied about the need of Child Care Leave to the probationer. It may also be ensured that the period for which this leave is sanctioned during probation is minimal.

3. It is reiterated that the leave is to be treated like Earned Leave and sanctioned as such.

4. These orders take effect from 1.9.2008. Earned Leave, if any, availed by women employees before availing CCL subsequent to the issue of the OM 13018/2/2008-Estt.(L) dated 18/11/2008 may be adjusted against CCL, if so requested by the employee.

    i have 11 month old child, my husband met with bike accident and ribs got fractured minorly. child care leave is essential for me.i applied for ccl and gave leave application for next 15 days. but the sanctioning authority is saying that for getting ccl, it must be applied well in advance and should be taken only after prior permission.
    what i will do??any idea for getting it sanctioned.

    My wife is working in CRPF , got her CCL got sanctioned by her Commandent.But her immediate superior officer is objecting to proceed on her sanctioned CCL.How to tacle this and proceed onher sanctioned CCL,Please help.

    I have applied for child care leave from 26.12.12 to 10.01.13. But my leave has been rejected on the ground that- ‘as the period of ‘Child Care Leave ‘ is spread over two calender Years-6 days in the year 2012 and 10 days in the year 2013. -This violets Conditions (i) & (ii) of the O.M. No.13018/1/2010-Estt..(Leave) dated 7th September 2010’ . In the abovementioned O.M. (O. M. No. 13018/1/2010-Estt. (Leave) dated 7th September 2010) it is not mentioned that CCL cannot be taken for a period covering two calendar years. Can I have a clarification on this point please.

    i am a central govt. employee. my husband is working abroad. i have 6 years old daughter. she misses her father a lot. she wants to go with him but not alone wants with me.she needs parents care & love at every time and stage. my husband will stay there for three years. one year has been passed. i and my daughter suffered a lot his absence.can i take benefit of this leave to go at my husband’s place. plese give me a reply and obligue me

    Respected ma’m/sir, After 6th pay commission the younger women employees are being benefited every time and elder women are being cheated. On one hand after the benefit of CCL which is encashed leave (730 days CCL means lakhs of rupees are being added in women’s accounts, specially those women employees whose children are teenagers ( mothers of children of 15 to 18 years group) that too without any work and having rest and rest at home with increasing no. of E/Ls+HPLs every year +CL/s+R/Hs and other gazetted holidays. Except all this they are being benefited by the tution fee for two children that too means that if 15000/- is being granted for one child then for two it will become 30,000/- every year. But the point to think is that in nursery to primary the tution fee in public schools mostly is less than Rs. 1000/- then why govt. is paying 1000/- for those children. Some women say that they have opened the account of their children and deposit the extra tution fee given to them in their own account. I want to say to govt. that on one hand govt. is giving them CCL benefit + tution fee (tution fee again means lakhs of rupees to those women employees who are already benefitted by CCL). Govt. is not having any sympathy for the 3rd child. Atleast, when the govt. is giving lakhs of rupees for two children then why the 3rd child is being ignored. I request the govt. to kindly consider about the tution fee of 3rd child of the women who are also deprived of CCL.

    MY DAUGHTER IS OF 17 YEARS AND I WANT TO TAKE CCL AS SHE IS NOT PAYING ATTENTION IN HER STUDIES . SHE IS A STUDENT OF XII CLASS(CBSE),CAN I GET THE CCL FROM AUGUST (2011) TILL HER BOARD EXAMS(NEARLY MARCH 2012).I WILL BE HIGHLY OBLISED IF YOU SUGGEST ME ABOUT A BRIEF KNOWLEDGE OF CCL .

    The no. of CCL granted to central government women employees is 730 days. It means a women can take nearabout 45 days CCL in a year from the child’s birth to 18 years of his age. Govt. has made a mistake by issuing the clause that it may be taken in 3 spells of more than 15 days but not restricting it to 45 days in a year. If the child care leave is restricted to 45 days in a year in 3 spells it could not have been misused by the women whose children are about 16 to 18 years because with the increasing age of child the CCL could have been decreased every year and a mother of 16 to 18 years of a child have not taken CCL so hurridely that she has to finish this CCL in two years or one year. Then the balance of CCL in mother of a 16-18 years child will be 135 days only. This is the reason why the women employees who have this facility are attending office after taking 3 or 4 months CCL, come to office for a week and after that they go again on CCL. The limit of CCL should be restricted to 45 days in 3 spells not more than 15 days in 3 spells. If attention is given to this point by the authorities no woman can take more than 45 days CCL in a year and with the increasing age of a child the CCL balance will decrease. The will also benefit the govt. by both ways i.e. financial and manpower in the offices. The women employees who have never worked in the offices after their appointment are having chance to get both the benefits i.e. CCL which is encashed leave, their earned leave balance is also increasing because unnecessarily they are availing the facility of CCL, financial benefit, and also after retirement they will again be benefits by encashment of their EL. In this way they are getting both the benefits. The CCL should be restricted to 45 days in a year as mentioned by me above. An amendment should be issued taking this point into consideration by the authorities. Thanks

    Child care leave for third child should be allowed as ltc facility is allowed in respect of third child if the birth took place before
    october 1998. OM 23.09.2008. expln below rule 4(d) ltc rules.

    In my case child care leave was allowed for third child for 4 months which i have availed. but even after sanction and availing it now office is granting 4months half pay leave in lieu of availed
    child care leave. This action of authority is against the law of natural justice . I am forcibly required to get my pay deducted from my present/future pay bills.

    please enlighten if leave once sanctioned and availed can be rejected and pay can be recovered?

    i am working in mgvcl company of gujarat government ,i am having
    only one daughter who is studing in std ten and she is suffering form major dipression form april 2009. i want leave to take care of the daughter for atleast one year as i m the only medicine for her.is there any special benifit of leave or CCL for the woman employee of gujatar government having only one daughter so that i can take care of my daughter ,hence can save a girl child

    I am an employee in Defence department. I have applied for one month CCL, my immediate office rejected it saying that defence employees are not eligible. In case the officer is not ready to sanction the leave, whether I can approach higher authorities or any other department

    I wish to state with regard to this order that though instructions have been issued, it is far from implementation. I had applied for 2 years CCL that was rejected then I had applied for 6 months and that is also rejected. My child is in std X. Twice bitten, twice shy, I am apprehensive to apply for leave. Will I be granted 4-5 months leave at a stretch? Has any woman got long CCL sanctioned in her favour? I feel there is a terrible staff/labour crunch in the government organisations. This situation needs to be addressed immediately.

    with all these remarks and suggestions given in regard to CCL i feel that the best solution will be to work out something like flexi hour work schedule, where women can work for 4 hrs in office and 4 hours from home. alternatively 4-5 hr work schedules can be made for women to either come to office in the morning session or in the afternoon session. this will enable them to balance both the fronts. when the child is too small it is difficult to come in the mornings to office – at such times the women can come in the afternoon. at times when the child starts going to school women can come to office in the morning when the child is also in school and could go back when the child is home. If the timings of mother and child are synchronised, it will work out better.

    Respected Madam,
    I am a senior woman employee having two children above 18 years. After the announcement of CCL those women whose children are in 11th & 12th Class are going on leave for long periods e.g. if they join office after one month’s leave and work for one week they again go on CCL because they have to finish 730 days CCL granted to them. Their absence in the office burdened the other employees who are not getting this facility even being senior. Kindly grant this CCL to all women employees senior or junior so that every woman employee take benefit of this leave and specially senior women can also take a sigh of relief who have wasted their EL in bringing up their children after a long period of service and faced the struggle every day passed.

    I am working in central govt organisation, and having twins who are studying in +2 appearing for Board examination. I have applied for CCL from 17.01.2011 to 25.5.2011.(Both under weight, eyesight problem,one is pure science group,another is computer science, anticipating aieee and medical entrance exams i am extremely in need of leave.nobody to take care of my children except me.The fact was intimated in the Leave application itself,after obtaing initial of my branch officer, i proceeded on leave.whereas,the Officer-in-charge has returned/rejected and call for duty.I am not in the position to report duty. You are requested to suggest me for further course of action pl. The leave application is also returned to me by post alongwith the letter asking me to report for duty. Is it correct? Whether i can seek remedy from court,CAT etc.,since i am geniunely in need of leave and worked for more than 20yrs.sincierely this rejection/return of leave appln. affects me very much and i wish to exhaust all the ways and means to fight for this issue since the OIC is partial/biased and used to behave unhumuanly who is to retire from service shortly and he has commented badly about women who have employed and asked to lead their life with the salary of their husbands and to give VRS rather than seeking CCL to the representatives of women’s forum who have approached him about the refusal of my leave. pl. suggest me immediately about the action i have to take

    I am working in Income-Tax Department. My wife is working in State Government aided school at Guntur. Our Chief Commissioner has transferred me to Visakhapatnam on general transfer and they are telling that there is no chance to retain at Guntur or getting transfer near by place on the ground of spouse working. I have one baby boy who is 6 months old. You are requested to suggest me how should I get transfer to Guntur. Is there any right to me or not because of that my wife’s post is non-transferable. Please clarify me.

    Madam, I am a school teacher in primery school .i want to avail child care leave from 17 jan 2011 to 28 april 2011, to look after my elder son who is in 12th class and also preparing for engineering entrance exams but my DD has senctioned CCL from 17 jan 2011 to 31 jan 2011 and he says CCL is not my right.Is ccl not my right? There is no one at home to look after him. You are requested to suggest me how should I avail my CCL.

    Thanks a lot madam for giving us this ccl. This has made our life comfortable and stressfree but madam our staff consists mostly of ladies and workload being much our applications do not get sanctioned. Therefore madam it is a request to remove this condition of the children being 18 years and making it due for the entire service, thus we will not be in a hurry to finish it off and can use it relaxedly.     Madam, I am a working mother of children above 18. I faced a lot many problems and lived a very struggful life in bringing up my children and in taking care of my sick husband. The CCL now is granted to mothers of below 18 years children. Kindly grant this leave to us also as children above 18 also need parents when they face problems in studies and we have also to take care of them. Kindly extend the period of this leave till retirement.

    i have been sanctioned ACP w.e.f 27.01.2006 in the prerevised scale of Rs. 6500-200-10000. before 27.01.2006 i was in the pay scale of Rs. 5000-150-8000. my date of increment is january. plz fix my pay as on 1st jan 2006 asa well as on 27.01.2006 and also on 017.2006 with DNI

    I, senior woman, after 27 years of service, after facing so many problems when my children were requiring mother’s care and love, request your kindness to kindly consider senior women employees The CCL should be as family care leave (FCL), which one woman can avail during her entire service period, so that every govt. woman can take benefit of this leave because children always need parents care & love at every stage. Waiting for a favourable decision. Thanking you.

    child care leave should be given till the retirement age because children are always like a child and need our care lifelong.

    Child care sanction should not be limited to three spells in a calendar year. One does, not know sometime (some years )everything is ok and in some year there are too many problems like exams, health problems and if you have 2 small children for whom should we take CCL and for whom we should not is very difficult. So pls…….the limit of three times should be removed.

    Respected madam Simi R Nakra, I do agree with Madam Lalitha. As mentioned by her above that she is having health problems, I am also having some medical problems. I shall be very much grateful to you if you also think about senior govt. women employees. Secondly, women being mothers have to look after their children and family at every stage. Beyond 18 years this is the time to make careers of children and their studies are also important in this competition time. Children also need care by their parents. So please extend this leave till the age of retirement so that every women senior or junior can take benefit of this leave. Hoping a favourable reply. Lot of thanks.

    I have promoted on 13/05/2009 and applied/requested for one year ccl as my child studying in X & XII standard. My department has rejected my request as I have not completed my probation period on promotion. Kindly guide me .

    Respected sir/Madam,
    I am a Central Govt. Emploee. My wife expired on 09/03/2010 leaving behind 7-1/2 year old child. Now I am the only member in my family to look after the child. Kindly intimate whether I am entitled to avail child care leave, as no other member male/female in our family.

    does this notification not apply to railways? The Indian Railways is silent on implementing this and is not releasing orders in this regard for implementation of CCL in its organisations, the reason is obvious though !!

    i am central govt. employee, inspite of the circulars issued, the situation in my office is that we have to take the sanction and it is upto the officer who sanction this. my son is having his exams. i have applied for 20 days leave which my officer is not sanctioning and overall is harassing me. can i proceed on leave ?

    i am working in DAE / Kalpakkam. I am the (senoirTech/H) person 51yrs.
    i dont have EL in my credits. but more than 27 yrs serviced.now a days i am having and getting medical problems.
    will You clarify the CCL is eligible for all working woman govt.emp in this. or pl consider our aged woman emp .for Health Care Leave HCL.
