Notification – amendment in Fundamental Rule 1970

NOTIFICATION

In exercise of the powers conferred by the proviso to article 309 and clause (5) of the article 148 of the Constitution, the President, after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, hereby makes the following rules further to amend the Fundamental Rules, namely:-

1.These rules may be called the Fundamental (Sixth Amendment) Rules, 1970.
2. They shall come into force on the date of publication in the Official Gazette.

In the Fundamental Rules, for clause (24) of Rule 9, the following clause shall be substituted, namely:-

“Presumptive pay of a post, when used with reference of any particular Government servant, means the pay to which he would be entitled if he held the post substantively and were performing its duties; but it does not include special pay unless the Government servant performs or discharges the work or responsibility, in consideration of which the special pay was sanctioned.”
