Anomaly arising out of the application of Rule 10 of the Central Civil Services (Revision of Pay) Rules, 1947

 OFFICE MEMORANDUM

 Subject:- Anomaly arising out of the application of Rule 10 of the Central Civil Services (Revision of Pay) Rules, 1947.

 In continuation of this Ministry’s O.M.No.F.10(26)-Est(Spl)/48 dated the 24th September, 1948, on the subject noted above, the undersigned is directed to state that as the orders contained therein constitute an important change in the conditions in which Government servants elected the prescribed scales, it has been decided that persons affected by these orders i.e. those having elected the prescribed scale from a date other than the 16th August, 1947 had their pay fixed at the initial stage of the prescribed scale and would have got a higher stage  in the prescribed scale had they elected that scale from the 16th August 1947, may be permitted to change the date of their election of the prescribed scales.  It has further been decided that in the case of persons who elect to change their date of election, any amount overdrawn for the period from 1st January, 1947 to 15th August, 1947 as a result of earlier fixation of pay is subject to recovery.

 2.The change in the date of election should be intimated to the authority concerned in writing on or before the 31st January, 1949.
